Zoning Text Amendment / Rezoning

The zoning amendment procedure is a discretionary review process to consider the rezoning of land, or the revision of specific policy language in the zoning ordinance. Information and procedures to have an interpretation of particular zoning provision(s) as it may apply to a given circumstance can be found on the Zoning Interpretation page.

Project description for rezoning shall indicate extent of area requested for rezoning and the rationale for the request.

Project description for zoning ordinance text amendment must be very clear as to what policy issue(s) would be under consideration.  Can include proposed wording of new/ revised provision, and should include references to all portions of zoning ordinance that pertain to the policy issue.  Should also state the rationale for the request.

 

Additional Information and Materials that May be Required

CEQA Exemption Form  (1 copy)
Certain classes of project may qualify for exemption from the environmental assessment (CEQA) process.  An additional fee is required. 

General Plan Conformance and Contiguity/ Annexation Form  (1 copy)
Required for property-specific rezoning proposal if subject parcel is located within a city's urban service area.

Assessor's Parcel Map  (1 copy)
Required if application is a property-specific rezoning proposal. 

Copy of Current Recorded Grant Deed  (1 copy)  
Required if application is a property-specific rezoning proposal. 

Evidence Showing Legal Creation of Lot  (1 copy)
Required if application is a property-specific rezoning proposal. 

Williamson Act Compatible Use Determination
Required for property-specific rezoning proposal if subject parcel is under a Williamson Act contract.  It is strongly suggested that this determination be applied for and resolved prior to ASA application submittal.  An additional fee is required. 

Mailing Labels (1 set)
Required for property-specific rezoning proposal if subject property is located within 300 feet of the exterior boundary of Santa Clara County.

Other Reports and Studies
Depending on nature of zoning amendment request, additional reports (e.g. arborist, biology, archaeology, noise) may be required.
