        The County of Santa Clara is the Lead Agency which has prepared a Recirculated Draft Environmental Impact Report (DEIR) pursuant to the California Environmental Quality Act (CEQA) to evaluate the potential environmental impacts for the Z-Best Compost Facility Modifications Project. Public comment period was April 20, 2023 to June 20, 2023.

          Application Status Update (April 29, 2022)

          In July 2021, the Applicant filed a lawsuit challenging the Department’s April 7, 2021, incompleteness determination under the Permit Streamlining Act (Gov. Code § 65920 et seq.).  The parties agreed to settle the lawsuit and asked the Court to enter the Stipulated Judgment.

          Pursuant to the Stipulated Judgment:

          • The Application was deemed complete as a matter of law on April 1, 2021.  The County’s April 7, 2021, Notice of Incomplete Application Letter had no legal effect on the status of the Application.
          • The Application is subject to the grandfathering clauses set forth in Section 8 of Ordinance No. NS-1200.378 and Section 2 of Resolution No. BOS-2021-63, adopted by the Board of Supervisors on May 25, 2021 (collectively, the “Amendments”).  
          • Accordingly, the Application shall be processed by the Department in accordance with all provisions of the County General Plan and Ordinance Code, including Appendix I (Zoning), applicable to Recreational Vehicle Parks that were in effect immediately preceding the effective date of the Amendments.
          • The court retains jurisdiction to enforce the Stipulated Judgment.

                  Description:​

                  Tree removal exemption. San Jose Water Company maintains a private easement referred to as Ellege Road in unincorporated Santa Clara County near the intersection of Black and Thomason roads in Los Gatos. Ellege Road is the sole ingress/egress route for 6 households located at the southern extent of the road. San Jose Water has identified approximately 20 mature Eucalyptus globus trees ranging from 16-50 DBH along the Ellege Road corridor that pose imminent risk to life and property. This includes numerous dead, diseased and dying trees, as well as trees that are not structurally sound and likely to fall on the road and/or infrastructure.                               The Mountain Winery is a concert and event venue in unincorporated Saratoga, located at the site of the former Paul Masson winery. On June 25, 2018 Mt. Winery applied to modify their previously approved July 2006 Architectural and Site Approval to complete the improvements authorized by that 2006 ASA. These improvements included a wine tasting room, winery plaza building, plaza deck building, office and storage facility, box Office, and garden terrace. This development proposed approximately 42,000 square feet within the boundaries and limits of the original 2006 ASA modification and the current approved Use Permit for the property. On October 4, 2018, the County of Santa Clara approved Mt. Winery’s proposed ASA modification. Currently, Mt. Winery has no applications in process with the County of Santa Clara.
